Terms and Conditions and Privacy Policy of PaperOffice Thank you for your interest in our product and welcome to PaperOffice. You will also find the terms and conditions, terms of use and privacy policy and license terms of PaperOffice. It explains your rights. Please read them carefully and accept them, before you can use the service. If our conditions are not available in the language you have selected, the English version will be displayed by default. Terms of Service of PaperOffice 1. General For all goods, services and offers of PaperOffice Limited (hereinafter PaperOffice, we, or us) those goods, services and offers are based on this business and licensing conditions. Terms and conditions of the customer (hereinafter mentiones contractor, licensee or user) shall not be accepted unless we have expressly agreed to their validity. Actions that we take which are part of our contractual duties do not count as an approval to contract conditions deviating from our conditions. These Terms of Service shall also be a basic agreement for all further legal transactions between the contracting parties and shall become invalid only if they are replaced by other general terms and conditions. The new or amended General Terms and Conditions are directly announced and transmitted by PaperOffice. These commercial terms apply to our commercial transactions with you, including your purchase of any paid service from us, or acquisition or redemption of any promotional codes. We refer to any service for which we charge a fee as a paid service. You should carefully read through these commercial terms to understand your rights and responsibilities, as these commercial terms constitute a contract between you and PaperOffice or its affiliate from which you are purchasing the paid service or from which you are acquiring or redeeming any PaperOffice promotional codes or PaperOffice points. By purchasing a paid service, or obtaining any PaperOffice promotional codes, you agree to be legally bound by these terms of service. We may update these commercial terms from time to time. The commercial terms published on our site at the time you purchase a paid service, or at the time you obtain, or elect to redeem, any PaperOffice promotional codes, will apply to your transaction. If you consummate any commercial transaction, you will be legally bound by the updated commercial terms. 2. Conclusion of contract An offer of a customer shall require a confirmation of order. The sending or handing over of the ordered goods to the client is also taken as completion of order. If we are made an offer, then the tenderer is bound to an adequate period of at least 30 days from receipt of the offer. An order confirmation sent by e-mail is not an order acceptance in the legal sense. When you elect to purchase a paid service or any product from us or any third party reseller and enter a form of payment, you agree that: (i) you will fulfill your obligation to pay for the paid service or product by the date on which payment is due; (ii) any payment information you provide is true and accurate; (iii) you are authorized to use the payment method you provide; (iv) we have permission to retain the payment information and method, including all submitted debit and credit card information, submitted by you and your issuing bank or the applicable payment network; and (v) we or our reseller (as applicable) are authorized to charge you for the paid service or product using the established payment method and the information you provide that is stored in your account as of the applicable date for payment. Your assurances of payment and our rights to collect payment include any obligation you may have to pay any taxes or delivery charges described as being applicable to the product you are buying. In addition, you agree that you will be responsible for any credit card chargeback fees as well as any reasonable collection costs we incur as a result of your failure to pay on a timely basis. You agree to pay the charges for the paid service or product in the currency specified by PaperOffice (or any reseller or payment processor from which you may purchase the paid service or product) when you enter into the commercial transaction, and you assume all risks associated with any changing value in the currency compared with other currencies. The specified charge for a paid service or product are VAT-inclusive and may include certain other taxes or delivery or similar charges applicable to your purchase. If any tax or charge applicable to a purchase is not charged by us, you acknowledge that you are solely responsible for paying the tax or other such charge. The charges for a paid service or product do not include VAT. The receipt you receive from us reflects the purchase price exclusive of VAT. VAT may be charged on request, depending on your location. Our prices for a Paid Service or Product do not include any of the third-party fees you incur in connection with using a Paid Service including, without limitation, fees charged by your Internet access provider, any wireless carrier charges for cellular or data services and any other third party applications or services with which you may use the Paid Service or Product; you are responsible for selecting and managing these other services, and paying the fees for such services. 3. Changes in fees / General price change We may change the price of any paid service from time to time, and add new fees and charges for certain features or to reflect a change in business or legal rules, but we will send advance notice of changes in recurring subscription fees by email to the address in your account information. Any increase in charges for the same paid service would not apply until the expiration of your then current billing cycle, unless otherwise specifically provided in our notice to you, and would become effective no sooner than the next time you would be charged for that paid service. If you do not agree to pay the new price or other applicable charges, you may elect not to renew the paid service subscription before the price change goes into effect, which cancellation would be effective at the expiration of your then current billing cycle. 4. Terms of payment, default interest Unless agreed otherwise, our requests for payment are to be paid on schedule against handover of the goods, this applies to all transfer, such as the transfer by mail, as a download or via entering the codes. Discount deductions are not permitted. Payments made by the customer shall not be recognized as paid until they have been credited to our business account, this also applies to payments made by third party services such as credit cards, PayPal, WesternUnion etc. In case of default of payment of the consumer we are enabled to demand the alternative of the actual accrued adversity, after our choice, or to demand default interests of legitimate size. In event of payment default by the customer, PaperOffice is entitled to demand compound interest from the day on which the goods were received (in case of digital goods: at least when the software is activated). We reserve the right to block program licenses, access, online services or cloud services in whole or in part, if payments to PaperOffice are partially or fully delayed for more than 7 days. 5. Contract withdrawal We are entitled to withdraw from the contract in the event of delayed acceptance of the goods or of other important reasons, such as, notably, bankruptcy of the contract partner or the filing of an application for insolvency proceedings against the assets of the contract partner, or if the contract partner is in default of payment, if the terms of the contract have not yet been fulfilled by both parties. Should it come to a cancellation of contract for which the customer is to blame, we are entitled to either; claim set damages at 35% of the gross invoice total or compensation for the actual amount of the damages occurred. If the customer is in arrears with payment we shall be released from all further obligations to perform and deliver and shall have the right to hold back outstanding deliveries or performance and to demand payments in advance and/or deposits, or to withdraw from the contract after setting a reasonable extended time limit. If the client cancels the contract without being entitled to do so or if he requests the cancellation, we will have the option to insist on the fulfilment of the contract or to consent to the cancellation of the contract; in the latter case, the client will be obligated to pay flat rate compensation for damage in the amount of 35% of the gross invoice amount or the actually incurred damage at our own choice. 6. Installation and agreed consultancy costs are calculated on the basis of the time required to perform them. The customer can conveniently book an installation, additional support, or consulting package. Only after payment is received the service is carried out by PaperOffice. Services for third-party products as well as support services for third-party products are calculated without exception and carried out at our conditions. Travel expenses are calculated without exception and carried out at our terms and conditions. 8. Delivery time We shall not be obligated to perform the contract until after the customer has fulfilled all its obligations which are necessary for performance, in particular all technical and contractual details, work in advance and preparatory actions. We are authorized to exceed the agreed dates and delivery times by up to six weeks. Only after that period, the customer may set a reasonable deadline to withdraw from the contract. 9. Minor modifications In the event that it is not about a consumption contract, it is deemed that the potential slight changes related to our obligations of services and deliveries are accepted beforehand. This is of particular concern in relation to (for example material, packaging and print design (design/logo)). 10. Compensation All claims for compensation shall be excluded in the case of minor negligence. Insofar as the matter does not involve a consumer transaction the existence of minor or gross negligence must be proved by the injured party. If it is not a consumer business contract, the absolute statute of limitation of damage claims is one year from the transfer of risk. The conditions pertaining to compensation for damages as stated in these terms and conditions or otherwise agreed shall also apply if the claim for compensation is asserted in addition to or instead of a claim under warranty. The applicable license terms are always indicated. Before connecting or transporting computerized technical products or before installing computer programs, the customer is obligated to secure already existing data on the computer sufficiently, otherwise he has to bear responsibility for lost data as well as for all related damages. These special terms are determined in particular in the license agreement for PaperOffice products and supplementary terms and conditions for IT services, which you agree to at the latest at the time of installation. 11. Product liability Recourse claims as specified in product liability law are excluded, unless the party justified for recourse proves that the fault and as a consequence the damage resulting from the original association of this fault can be attributed to stem from our area of control and are a result of gross negligence or intent, as far as material goods are concerned. 12. Reservation of ownership and assertion All goods are provided by PaperOffice for use, unless the customer concludes a lease-purchase contract. The usage period is selected by the user, the platform (software) is the property of PaperOffice and is provided only for paid period (or in case of the trial license – test period) and desired extent. 13. Applicable law and place of jurisdiction European law is applied. Application of the UN sales convention is expressly excluded. If the matter is not a consumer transaction, the technically responsible court at the registered office of our enterprise shall be exclusively locally responsible for ruling on all disputes arising from this contract. 14. Data protection, change of address and copyright The customer gives his consent that personal data contained in the purchase contract will be electronically processed and saved by us as part of the contract administration procedure and for marketing purposes. A transfer to third parties is excluded. The customer shall be obligated to inform us about changes in its residential and/or business address as long as the contractual legal transaction has not been fulfilled by both parties. In the event this notification is not given, declarations shall then also count as delivered if they are sent to the last notified address. Plans, drawings or other technical documentation as well as samples, catalogs, brochures, illustrations, etc., always remain our intellectual property, the customer does not receive any form of work use or exploitation rights. 15. Change of payment methods and account information You are responsible for ensuring that your account information, including e-mail address and all payment information (address, debit and credit card numbers, and expiration date) are accurate and up-to-date. You can change this information at any time. If your credit card expires, the information becomes invalid for other reasons, or you or another party in control of the payment method changes your billing account at the time we bill you for a paid service (so we can not reasonably respond to the changes prior to billing) we are unlikely to be aware of these changes and will debit the card shown in our records with the current amounts. Your continued subscription to a paid service entitles us to do so. Any unpaid amounts and any fees incurred by you or us as a result of billing an expired card will remain your responsibility. For all changes, please contact customer support. 16. Written form All correspondence and its amendments, as well as all declarations, notification and documentation obligations that are relevant to the contract, must be in writing, unless otherwise agreed. 17. Automatic renewal PaperOffice accepts certain debit and credit cards as well as other forms of cash payment (e.g., Paypal transfers) as payment methods for Paid Services (each, an “Accepted Payment Method”), subject to the procedures and rules contained in these terms of service and any applicable contract with the accepted payment method. Accepted payment methods may vary by country or by paid service and may change from time to time. When you purchase with an accepted payment method, the fees for your paid service will be billed on or near the date of your purchase. If you purchase a paid service subscription that renews automatically, such as monthly or annually, you agree that we may process your accepted payment method on each monthly, annual or other renewal term (based on the applicable billing cycle), on or near the calendar day corresponding to the commencement of your paid service subscription, as applicable. In addition, you agree that we have permission to retain and/or share with financial institutions and payment processing firms (including any institutions or firms we retain in the future) information regarding your purchase and your submitted payment information in order to process your purchase, and to use the email address submitted by you to provide you with notices and disclosures relating to renewals and recurring charges. If your paid service subscription began on a day not contained in a subsequent month (e.g., your service began on January 30, and there is no February 30), PaperOffice will process your payment on or near the last day of such month. 18. Paying by invoice PaperOffice may, in our sole discretion, agree to permit you to pay us for certain paid services pursuant to invoices issued by PaperOffice. Unless otherwise expressly provided in our separate agreement with you, we will issue our invoice on or shortly after the date on which the paid service is purchased and the charges are payable upon your receipt of the invoice. All payments of invoiced amounts must be made in the currency specified on the invoice by check, wire or other electronic transfer to a bank and account number designated by PaperOffice. Any invoice that remains unpaid seven (7) days after the invoice date is considered delinquent. Any wire transfer fees or other similar fees incurred on account of the payment method selected by you are your responsibility and may not be deducted from the amount due PaperOffice. 19. Paying our reseller or payment processor PaperOffice, in our sole discretion, enable you to purchase and/or pay for certain paid services through a PaperOffice -authorized reseller or payment processing firm (including, for example, a telecommunications provider or a mobile app marketplace). Unless otherwise expressly provided in a separate agreement with you, your obligation for payment to, and relationship with, such reseller or payment processor is a contractual matter between you and such third-party; PaperOffice is not a party to, or responsible on account of, such contract. While we select our resellers and payment processors carefully and enter into detailed agreements imposing performance obligations (including confidentiality) on them, we cannot and do not guaranty their performance. We encourage you to provide any feedback regarding any reseller or payment processor with which you do business to us, as we value and use your input in determining whether to continue or end such relationships. Terms of Service of Paper Office 1. The Terms of Service constitutes a contract between PaperOffice and you. The Terms include the provisions set forth in this document and in the PaperOffice privacy policy, user guidelines, terms of trade and other terms or conditions of Paper Office. We present these to you and you accept them (further referred to as "Terms of Service" or "Terms"). If you do not agree to these Terms, you do not have the right to access or use our Service. If you do register for or otherwise use our Service you shall be deemed to confirm your acceptance of the Terms and your agreement to be a party to this binding contract. By using the Service, you acknowledge, accept and agree with all provisions of the Privacy Policy, including, without limitation, the use and treatment of the text, images, and other data you choose to input, upload, or store in Evernote (collectively, “Content”) and your personal information in accordance with such Privacy Policy. 2. PaperOffice Software (as defined below), the PaperOffice services and other products, services and websites hosted or made available by Paper Office, including for example our app center, user forum and HelpDesk, support pages are collectively referred to in these Terms as the “Service”. In exchange for being enabled to use the Service, you agree to abide by these Terms 3. PaperOffice offers services for the agreements in the contract. The customer (hereinafter also referred to as contractor, customer and user) bears the responsibility and the project's success. Adequate protection of the data is the responsibility of the customer. Contractual services are not covered by the contract. 4. The contracting parties are only the persons named in the contract. Persons employed by PaperOffice will not enter into any working relationship with the client, even if services are provided in your facilities. 5. You retain the copyright of all your content prior to sending, publishing, or viewing the Service, but you must provide PaperOffice with a time-limited release, which is described below, so that your information is accessible and you can use the Service. In addition to this limited license and other rights granted to you in these Terms, PaperOffice acknowledges that it has no right, title or interest in its contents in accordance with these Terms. 6. For the purpose of obtaining permission for PaperOffice to operate the service, we receive from you certain rights of a limited license to process the content, so that technical measures that are operated in the service, are considered not to be illegal. For example, copyright law may prohibit us from processing, storing, backing up, and distributing content unless you grant us those rights. Consequently, in order to enable the use of the Service and the uploading of the Content, you give PaperOffice a license to display, present, distribute and modify the Content (for technical purposes, which ensures that the Content is visible to both Smartphones and including computers and other devices) for their playback to enable the operation of the service by Paper Office. You also agree that PaperOffice has the discretion to refuse to register, record, publish, display or transmit your data. You agree that these rights and licenses for tacit licensing, exempt from royalties, are global and irrevocable (as long as your content is stored with us), including the right that PaperOffice has, such content and rights to third parties Make available to those who use PaperOffice to provide contractual relationships related to the provision of services by PaperOffice solely for the purpose of such services, and if not, to allow access or disclose their contents to third parties, if PaperOffice determines such Disclosure is required to comply with its legal obligations. By uploading or distributing your Content to us, you represent and warrant to PaperOffice that they have the legal rights and full authority to submit your Content to Paper Office, as well as to any user, to publish or distribute the content mentioned while using the Services and to grant You the rights to PaperOffice under these Terms. Finally, you understand and agree that PaperOffice can take all necessary and technical steps to provide service to the user, make changes to your content, and customize it for networks, devices, services, or media. 7. If you use PaperOffice services to send support messages from HelpDesk and from the chat system to an email address, phone number via text message, or social networking account (eg, Facebook or LinkedIn) that does not match PaperOffice sends these messages on your behalf, we trust in your statement that you have a direct connection to the recipient or recipients, and that you respect the legal rights of the recipient or recipients, not receive certain types of messages (eg harassing, unwanted or commercial messages). Rights to content If you own content that is stored by PaperOffice Services (including third parties), you acknowledge and agree that PaperOffice (and our licensors) own all rights, titles and legal interests in and for the Service including, without limitation, complete software that may include a portion of the Service stored on the Paper Office's servers and all types of PaperOffice software that you or a third party have used to collect content from outside Services, such as the use of Paper Office, FileHandler, ScreenCapture, ScanConnect, WebCapture, PasswordSafe, SmartSpell or PrinterConnect, and other PaperOffice software, to provide compatible electronic devices that allow the device to access and use the Service ("Software from Paper Office"). 10. Intellectual property rights By agreeing to these Terms of Use, you also agree that the rights to the PaperOffice services and software, including intellectual property rights such as trademarks, patents, designs and copyrights, are governed by one or more copyright, trademarks, patents, Trade secrets and other laws, regulations and treaties are protected, in addition to these terms and any separate agreement. In particular, you agree not to modify the source code, create derivative works, decompile, or otherwise attempt to modify this and all others of Paper Office, unless you have been specifically authorized to do so. 10.1 To change rights services We reserve the right, at our sole discretion, to implement new elements and / or additions to the Services, including changes that may affect the prior functioning of Paper Office's services or software. We assume that any of these changes will improve the overall service, but it may be that you disagree with us. We also reserve the right to set limits on the type and size of storage that will be provided to you, the number of transfers, the number of emails that can be sent and received, the type and size of each directory, type or ongoing performance of the service Accessing and distributing the data and content, as well as raising other restrictions at any time with or without notice. PaperOffice will endeavor to provide an option to install or not update these updates, but under certain circumstances (for example, security risks), PaperOffice may ask you to install the update to maintain the service available. In all cases, you agree with PaperOffice delivering (and receiving) 11. You may terminate the PaperOffice account with our service at any time for any reason (or without cause) with or without prior notice, depending on the nature of the PaperOffice account. If you want to apply for the PaperOffice account deactivation, certain steps must be taken. PaperOffice may take steps to temporarily limit your use of the Service or to block access to your account with or without notice in accordance with these Terms. The reasons why PaperOffice may close or block your account include, without limitation: (i) failure to comply with these terms and conditions (including the User's Guide) or any separate agreement; (ii) non-payment of fees or other payments to PaperOffice or parties connected to the use of the Service; (iii) disruption or alteration to the Service Materials (or any part thereof); or (iv) unexpected technical or safety issues, or unsuitable (compatible) prolonged use. We reserve the right to suspend all or any portion of software licenses, access, online services and cloud services if the user is in default of payment for more than 7 days. 12. We may include and recommend third-party resources, materials, and developers, and / or links to third-party websites and applications as part or all of the Service. (b) PaperOffice does not warrant that (i) the Service will meet your requirements; (ii) the service will be uninterrupted, timely, secure or error-free; or (iii) all errors in the software or service will be corrected. (c) Any material downloaded or otherwise obtained through the user of the service is done at your own discretion and risk and you are solely responsible for any damage to your computer or other device or loss of data resulting from the download or use of such material. (d) The advice or information you orally or in writing received from PaperOffice or through the use of the Services will not be subject to any warranties or obligations other than as provided in the applicable terms and conditions. However, you expressly acknowledge and agree that: Paper Office, its affiliates, subsidiaries or service providers and licensors, and our and their respective executives, employees, agents, and successors are not liable for direct, indirect, specific, or indirect damages, including, but not limited to damages for loss of profits, goodwill, use, data, cover or other intangible losses (including if PaperOffice has been advised of the possibility of such damages) resulting from: (i) use or inability to use the Services or the use of promotional codes or the (Ii) Procurement costs for replacement goods and services resulting from purchased or received goods, data, information or services, messages received or transactions completed through the Service; (iii) unauthorized access to or changes to your Transactions transactions or data; (iv) any statements or behavior of third parties regarding the Service; or (v) acts and omissions of PaperOffice in accordance with trusted account information, as well as any changes or notices thereof; (vi) your failure to protect the confidentiality of passwords or access rights to account information; (vii) actions and omissions of third parties using and integrated into the Services; (viii) any promotional content or purchase or product use or service advertised, as well as other third party products and services; (ix) your account termination in accordance with the Terms of Use; or (x) any other matter relating to the Service. Exclusions and limitations Nothing in these terms of service (including the limitation of liability provisions) is intended to exclude or limit any condition, warranty, right or liability which may not be lawfully excluded or limited. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by willful acts, negligence, breach of contract or breach of implied terms, or incidental or consequential damages. Accordingly, only those liability and other limitations which are lawful in your jurisdiction (if any) will apply to you and our liability is limited to the maximum extent permitted by law. 13. PaperOffice spreads notifications via emails (to the email address, which was deposited for your account). Therefore, you must provide your email address correctly and ensure that it is always up to date. 14. Providing the full versions for testing, you are able to fully test the largest version. The trial period is set by us and can change. By deploying, we enable the user to test the software in a real-world scenario and the actual infrastructure. The trial version is and must be installed by the customer, only then can this be changed into a fully fledged, affordable version. By changing the version to a payable one, you expressly agree that the version you have previously tested and you agree with everything. Collaboration and authorization information The PaperOffice service includes some features for collaboration. License terms of PaperOffice By using PaperOffice, you signify your consent to these Terms. PaperOffice is provided by PaperOffice ltd. "PaperOffice" or "We" refers to PaperOffice ltd. The Services we provide you with are the joint efforts of us and our branches, affiliates and partners across the globe. "You" refers to the user of PaperOffice. You should be an individual rather than an entity. "PaperOffice Account" refers to the account you registered through our products or website, and you may only use the services we provide after you have signed in your PaperOffice Account. In addition to these Terms, the Privacy Policy and other business rules we issued also constitute a part of these Terms. Please read them carefully. I. PaperOffice "PaperOffice" refers to the software we provide to scan, recognize, administrate, store, convert and share documents, etc. and related internet value-added services (hereinafter referred to as "the Services"). Software licensing and scope of services We grant you an individual, world-wide, non-transferable, revocable and non-exclusive license to use PaperOffice. Unless otherwise agreed in writing, you may install, use, display, and run the Software for the test period or the rental period. When using Rental Purchase Models, the license will be provided to you for use until the full purchase price has been paid. In the case of omission or suspension of a payment, the already made payments expire. After a complete and seamless payment, the license will be converted into a lifetime license without any consequential costs. III. Paid services Some services of PaperOffice are provided for a fee and you may only obtain such services after you have paid related fees in time and in full. About paid services, we will ask your consent before charges. Paper Office may amend and change the rate and methods of the fees if necessary. Some free services may be converted to paid services and you will not be able to continue to use such services after the fee is collected for the services if related payment is not made in time and in full. The foregoing change will be notified or announced via the website of PaperOffice or you will be prompted within certain time period before you use corresponding services. The price of the products provided through the website may be changed at any time. In case of price cut or promotion activities, Paper Office will not provide price protection or refund. As software products include licensing and activation information and are special customized (including but not limited to activation code, creating of master key licenses and password) and are special commodities, "returning articles" will NOT be applicable after the transaction is confirmed and there will be no replacement. User registration, test period and safety of accounts In order to use PaperOffice better, we suggest you registering a PaperOffice Account, and signing in your PaperOffice Account when using our products and services. The software of PaperOffice falls under the term digital good and is customized to the customer. Since every customer MUST go through a test period of 14 days, he will be provided with an appropriate test period free of charge. Thereafter, at its sole discretion, he may change its license to a full one, and implicitly agrees with the functionality and has no claims for improvement. You are required to keep the password of your PaperOffice Account properly and be responsible for all the activities carried out under the PaperOffice Account. You are kindly reminded to take specific measures to protect the safety of your PaperOffice Account, including but not limited to proper keeping of account password, installation of anti-virus software and antispyware, changing password regularly and signing out after use, etc. If your PaperOffice Account and password are embezzled, you shall be liable for all the liabilities and consequences incurred during the period of embezzlement, unless you may prove such embezzlement is due to our intentional misconduct of gross negligence. If you find that any person is using your PaperOffice Account without authorization, please contact and notify us immediately. V. Privacy and personal information PaperOffice is committed to the privacy and security of your data. We respect user’s personal privacy and will protect your privacy and personal information according to actual law. The information and Contents contained in PaperOffice will be protected by copyright law, patent law, trademark law and other relevant laws and regulations. Unless we and you otherwise agreed in writing, these Terms has not authorized you to use the name of any software, trademark, service mark, logo, domain name and other labels which have prominent features of the brand in respect of PaperOffice. IX. Limitation of Liability 1. Please directly visit our website at https://www.paperoffice.com, to download the installation procedures of the Software or know any other safe downloading channels we have authorized. You are required to create PaperOffice Account and use the Services through the official channels we provide including the use of the Software or visiting the website of PaperOffice https://www.paperoffice.com . Otherwise, we are unable to guarantee the safety of your software, services and account. In addition, we will not be liable for any loss incurred by you or any third party due to your use of unauthorized software, service or account. 2. You are required to use PaperOffice in a proper way. For the detailed functions and operations, see User's Manual and help document. You may also contact us directly to obtain necessary help. You will be liable for any loss due to your improper setting or improper operation. 3. You fully understand that PaperOffice will involve internet services and may encounter various risk factors such as force majeure which may cause the relevant series be suspended. We will use our best efforts to conduct timely repair, provided that you shall be solely responsible for all losses incurred thereby, and we are not liable. We will not provide any guaranty of any kind for any unpredictable or uncontrollable technical defect in the product, service stability and any loss or damage thereby caused; unless otherwise provided by laws and regulations. 5. You fully understand that when using the services, you may meet the risk from internet information or behaviors of other users. We are not liable to the facticity, usability and legality of any of such relevant information, as well as your infringement caused by the same. The risks of the information include but not limited to: •(1). The information including threatening, defaming, disgusting or illegal contents from others anonymously or personate; •(2). Any psychological, physiological or economical damage resulted or possibly resulted by the others’ misadvise, cheat or otherwise when using PaperOffice; •(3). Other risks caused by internet information or other users’ behaviors. X. Use by juveniles PaperOffice does not directly target any juvenile users. If you are a juvenile user and decide to use PaperOffice anyway, please first have the consent of your guardian and/or other adult with guardianship duties and use the Software under the guidance and supervision of your guardian or any other adult with guardianship duties. Your continual use will signify your acceptance of the Contents of the amended Agreement. XIII. Amendment to and interruption, suspension and termination of PaperOffice 1. You may terminate the use of PaperOffice at any time. 2. The Software will provide update from time to time and you may decide at your own discretion whether to accept the updates. If you choose not to update, we will not guarantee to provide you with the latest services, and you shall be solely responsible for any loss thereby incurred. 3. We reserve the rights to amend, interrupt, suspend or terminate to provide the service of PaperOffice according to the actual situation at any time, which includes but not limited to the size of the storage space of a single user, the type and amount of the update and other data and the ability of access to PaperOffice continuously, etc.. We will make reasonable effort to announce you. Generally, we will provide you high quality services, and the situation of such term will only appear under special condition when necessary. 4. In case of any of the following, we have the right to suspend or terminate the services provided to you without giving any notification: •(1).
